Understanding Appeals

An appeal is different from a new trial. The dispute in a criminal trial is generally about the facts of the matter. In an appeal, the dispute is about how the lower court applied the law to the facts. With that in mind, an appeals court generally does not accept new evidence about the facts of the case. Instead, it defers to the version of events found by the lower court, which are known as the record.
